Terms and Conditions
These Terms and Conditions govern the end user Player's (the "Player") use of the services available on Bet Swagger.
- By ticking the box next to the “I agree to the Terms and Conditions” and clicking on the “SUBMIT” button during the Player’s registration, the Player acknowledges and accepts that:
1.1 the Player has fully understood, read and accepted these Terms and Conditions; and
1.2 these Terms and Conditions constitute a legally binding agreement (“Agreement”) between the Player and the Operator regarding the use of the services:
- The services provided to the Player for their continual non-commercial use are subject to these Terms and Conditions.
- If the Player does not agree with any of the Terms and Conditions the Player should not click the box next to the “I agree to the Terms and Conditions”, should not click the “SUBMIT” button and should not attempt to use or continue using any of the services or download and/or install the software.
- If there is any deviation between these Terms and Conditions and any other document incorporated by quotation, these Terms and Conditions will overrule any such quotation.
2 MODIFICATIONS TO THESE TERMS AND CONDITIONS
2.1 The Operator reserves the right to modify these Terms and Conditions and the Rules of the Games at any time. Any such updates, changes or modification will be published on the website.
2.2 The Player endorses and agrees that it is the Player’s sole responsibility to check for any such modifications, updates and/or revisions. Usoftgaming N.V. (DBA Bet Swagger) may, in its sole discretion, notify the Player of such updates and modifications. Such modifications, as may be provided by Usoftgaming N.V. (DBA Bet Swagger) at its sole discretion from time to time, shall not constitute an obligation upon Usoftgaming N.V. (DBA Bet Swagger) to notify the Player of such amendments and updates.
2.3 The modified, updated or changed Terms and Conditions and the Rules of the Games shall be effective upon announcement on the Bet Swagger website. Continued use and participation in the services on or through the Website after such updated modification establishes the Player’s acceptance to the modified/updated Terms and Conditions and/or Rules of the Games as announced from time to time.
3. USE OF THE PLAYER'S ACCOUNT AND PLAYER REGISTRATION
3.1 To register an account to use the services (a "Player Account"), the Player must be at least eighteen years of age (18+) to play any games offered by Bet Swagger.
3.2 When a Player registers their account on the Bet Swagger website, they will be asked to create a personal login and password (which will be encrypted and not accessible by Bet Swagger). In order to avoid fraudulent activities, the Player must keep this password confidential at all times and not disclose it or share it with anyone. If the Player knows or suspects that someone else knows their password or that any other personal information has been stolen or otherwise accessed without their authority they should notify the Operator immediately by contacting the Support Team at [email protected].
3.3 The Player must ensure that the details provided by them during registration (or at any time thereafter) are correct and accurate and must inform the Operator immediately of any changes to their details by updating their Player Account, in the player profile section or via email to [email protected]. The Operator reserves the right to request personal identification documents (example: Passport, utility bills, bank statements and any other document the operators deems appropriate) for verification purposes. This is normal practise and requirements for our payments to players by Pulsion Processing LTD (as payment processing agent) which will hamdle the majority of payments for Usoftgaming N.V. (DBA Bet Swagger).
3.4 The Player will not allow any other person or third party (including, without limitation, any minor) to use their Account. The Player is solely responsible for all use of the ServiceS through their login and password. Unless caused by the Operator's negligence, any unauthorised use of the login and password will be the Player's sole responsibility and deemed the Player's use.
3.5 If the Operator has valid reason to believe that there is likely to be a breach of security or misuse of the Service, it may require the Player to change their password or it may suspend the Player's Account.
3.6 The Operator may suspend or terminate the Player's Account immediately at its absolute discretion including if the Player breaches any of their obligations under these Terms and Conditions.
3.7 The expiry or termination of a Player's Account for any reason will not affect:
1. any rights, obligations and/or liabilities accrued before the date of termination or expiry; or
2. any rights, obligations and/or liabilities expressed to continue in force after and despite expiry or termination.
3.8 The Operator reserves the right not to open an Account for any applicant without having to provide any reason whatsoever. The Operator further reserves the right to refuse/reject and suspend and/or terminate without prior notification the Account of any Player who is suspected of cheating, hacking, attacking, manipulating or damaging the Operator's normal gaming operations (including the Service).
3.9 The use of artificial intelligence or "bots" on the Service is strictly forbidden. Likewise, any application that uses any or all of the data contained on the Service for purposes (including but not limited to commercial purposes) other than participating in the Service (e.g. via screen scraping) is prohibited. The Operator will take measures to prevent and detect the use of programs that are designed to enable artificial intelligence (non-humans) to utilise or benefit from the data contained on the Website. Any attempted or actual use of artificial intelligence by the Player will lead to termination of their Account in accordance with clauses 3.9 and 3.11.
3.10 The Player can cancel their Account at any time by informing the Operator in writing at [email protected] If the Player does so, they must stop using the Service.
3.11 The suspension or cancellation of the Player's Account will not affect either party's statutory rights or liabilities.
3.12 The Player may open only one Account. Any additional accounts that are found may be closed or all such accounts may be treated as one joint Account, in either case at the Operator's discretion.
3.14 The Operator does not intend to provide its services to residents of jurisdictions where gambling is restricted. We take no responsibility for assessing the legitimacy of online gambling for any jurisdiction. The Customer hereby accepts their responsibility for determining whether participation in games of chance is permitted by their local laws, as well as for any consequences that may arise from the above-mentioned activities.
3.15 Internet gambling may be illegal in the jurisdiction in which you are located; if so, you are not authorized to use your payment card to complete this transaction.
3.16 It’s the Cardholder's responsibility to know the laws concerning online gambling in the Cardholder's country.
3.17 Once a deposit is made into the casino we cannot refund or cancel the transaction. The player will have to undergo a one time verification to assure it complies with our company policies and other terms. Once the verification is complete the player/client can then cashout the funds.
3.18 Internet gambling may be illegal in the jurisdiction in which you are located.
3.19 All payment disputes will be handled under Cyprus law
4.1 The Operator grants the Player a personal, non-exclusive, non-transferable and revocable licence to install and use the software required for the use of the Service (the "Software"). The Player may use the Software solely for participation in the Service.
4.2 The Service and all pictures, graphics, photographs, animations, videos, music, audio, text and live feeds on the Website and the Software are and will remain the property of the Operator and are protected by intellectual property laws, including copyright. They may not be reproduced without the Operator's prior written consent.
4.3 Except as permitted by these Terms and Conditions, the Player may not copy, use, modify, create derivative works from or distribute the Software or written materials associated with the Service, decode, reverse engineer, dissemble, decompile or otherwise translate or convert the Software or any part of it or transfer, loan, lease, assign, rent or otherwise sublicense the Software or do any of the above to any copy, adaptation, transcription, or merged portion of the Software. Without limitation, the above activity includes any form of denting, hacking, manipulating, attacking or damaging of the Service.
4.4 The Player acknowledges and agrees that the software and software user documentation provided on the Website is owned by the Operator and/or its licensors and is protected by copyrights, trademark rights and other forms of intellectual and proprietary rights. The Player acknowledges that the structure organisation and source code of the software are the valuable trade secrets of the Operator and its licensors. The Player acknowledges that except for the rights granted to the Player in accordance with the licence, the Player does not acquire any rights or interest whatsoever in the Software and/or the Software user documentation.
4.5 Upon the termination of this agreement for whatever reason, the licence issued under this agreement is automatically revoked and the Player shall stop using the software and the Player shall uninstall the software.
5.1 The Operator performs random security checks. The Player hereby accepts that the Operator maintains the right to demand additional documentation in order to verify the Player's Account details in the event of such a security check.
5.2 The Player must inform the Operator as soon as reasonably possible if they believe that their Account information is being misused in any way by a third party so that the Operator may suspend their Account. The Operator will not be held responsible for any reasonable delay in such suspension.
6 MONITORING DESCRIPTION AND PROCEDURES
6.1 In accepting these Terms and Conditions you acknowledge and agree to be bound by the Operator’s Monitoring Description and Procedures which are posted on the website and which can be accessed by clicking on the link Monitoring Description and Procedures.
7 GAME RULES
7.1 In addition to accepting these Terms and Conditions, you acknowledge and agree to be bound by the specific "Game Rules" for each particular game, which are posted on the Website from time to time by us.
8 THE PLAYER'S REPRESENTATIONS
8.1 The Player represents, warrants and certifies that they have reached the age of 18 or the legal age required for gambling in the Player's jurisdiction, whichever is the greater. You must be 18 years of age and above to register and play, this is one of our most strict policies. The player understands this and will only sign up and register if they are over the age of 18. No underage players are allowed on Bet Swagger.
8.2 The Player represents, warrants and certifies that they fully accept that all computer instructions and responses sent over the Internet to and from the Service and the Software will be binding on the Player.
9 NO WARRANTY
9.1 The Operator will endeavour to provide the Service using its reasonable skill and care. The Operator makes no further warranty or representation, whether express or implied, in relation to the Service. Any implied warranties or conditions relating to satisfactory quality, fitness for purpose, completeness or accuracy are hereby excluded.
9.2 The Operator makes no warranty that the Service will meet the Player's requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Service or the server that makes it available are free of viruses or bugs, nor does the Operator make any warranty as to the full functionality, accuracy, reliability of the materials supplied by the Operator or results of the Service or the accuracy of any information obtained by the Player through the Service.
9.3 The Player should be aware that the quality of connections via the internet connection to the Service varies from Player to Player and may not be absolutely stable.
9.4 The Operator carries out regular maintenance to its Service to ensure, as much as possible, that an optimum gaming experience is provided to the Player. During such maintenance sessions, the Player acknowledges and agrees that access to the Service may be limited to allow for such necessary repairs, maintenance or the introduction of new facilities or services. The Operator will make reasonable efforts to notify Players of such downtime in advance of it occurring (whether via an advance schedule of downtime or period notifications on the Service) and resume the service as soon as it reasonably can.
10 LIMITATION OF LIABILITY.
10.1 The Player agrees that their use of the Service is at their sole risk.
10.2 The Operator will not be liable in contract, tort, negligence, or otherwise, for any loss or damage whatsoever arising from or in any way connected with the Player's use of the Service, whether direct or indirect, including, without limitation, damage for loss of business, loss of profits, business interruption, loss of business information, loss arising from downtime or any other pecuniary or consequential loss (even where the Operator has been notified by the Player of the possibility of such loss or damage). Further, liability for such damage will be excluded, even if the exclusive remedies provided for in these Terms and Conditions fail for their essential purpose.
10.3 The Operator will not be liable or responsible to the Player for any loss or damage incurred or suffered by the Player as a result of any suspension or stoppage (whether temporary or permanent) of the Service arising from any governmental order or change in policy by the regulator.
10.4 The Operator will not be responsible or liable to the Player for any loss of content or material uploaded or transmitted through the Service and the Player confirms that the Operator will not be liable to the Player or any third party for any modification to, suspension of or discontinuance of the Service.
10.5 The Operator reserves the right to withdraw the Service or elements of the Service at any time, and will not be liable to the Player as a result of any such action.
10.6 The Operator will not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
10.7 The Operator will not be liable to the Player for any use of the Service that is contrary to the law of the jurisdiction in which the Player is located. The Player should note that where local law prohibits their participation in the Service, it is contrary to these Terms and Conditions for the Player to participate in the Service.
11.1 The Player agrees fully to indemnify, defend and hold the Operator, and its officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liabilities, damages, losses, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by the Player or any other liabilities arising out of the Player's use of the Service or use by any other person accessing the Service using the Player's Account details.
11.2 The Player agrees fully to indemnify, defend and hold the Operator, and its officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liabilities, damages, losses, costs and expenses, including legal fees, arising out of any breach of warranties or representations.
11.3 The Player will indemnify the Operator for all losses and damages suffered by the Operator as a result of wrongdoings and/or fraud committed by the Player or group of Players acting in concert or as a syndicate. "Wrongdoings and/or fraud" will include but not be limited to attempts to breach the Gaming Rules, single account per player rule, to exceed the free play betting limits, hacking, use of artificial intelligence or bots, providing false personal information, and/or any actions and/or omissions, which the Operator reasonably deems to be a fraud and/or wrongdoings.
The Player may not transfer any of their rights under these Terms and Conditions to any other person. The Operator may transfer its rights under these Terms and Conditions to another business where the Operator reasonably believes that the Player's rights will not be affected.
12 THIRD PARTY CONTENT
12.1 The Service provides content from other Internet sites or resources ("Third Party Content") and while the Operator takes all reasonable steps to ensure that material included on the Service is correct, reputable and of high quality, the Operator does not make any warranties or guarantees in relation to Third Party Content and will not be held liable by the Player for any such Third Party Content. If the Operator is informed of any inaccuracies in the Third Party Content contained on the Service, it will attempt to correct the inaccuracies as soon as it reasonably can.
12.2 The Operator makes no representations or warranties regarding any third party websites linked to the Service ("Linked Sites"), the entities which operate the Linked Sites or which feature on the Linked Sites. The Operator will not accept liability for any loss (including any indirect or consequential loss) or damage the Player may suffer directly or indirectly as a result of using any of the Linked Sites or relying on any material contained therein. The Player acknowledges that the Player's access to and use of any of the Linked Sites is entirely at their own risk.
13 THIRD PARTY RIGHTS
Except insofar as these Terms and Conditions expressly provides that a third party may in their own right enforce a term of these Terms and Conditions, a person who is not a party to these Terms and Conditions has no right under local law or statute to rely upon or enforce any term of these Terms and Conditions.
- SETTLEMENT OF DISPUTES
The Player understands and agrees that (without prejudice to their other rights and remedies, including the referral to an agreed dispute resolution process) the Operator's records and subsequent management decision will be the final authority in determining the terms of the Player's participation in the Service, the activity resulting there from and the circumstances in which they occurred.
If the Player has any dispute with regard to any outcome of the games or any other activity, the Player must submit their complaint to the Operator in writing within fourteen (14) days of the incident by email to [email protected]. Any notice the Operator gives to the Player (save as otherwise set out herein) will be sent to the email address that the Player provided when the Player registered the Player's Account. It is the Player's responsibility to give the Operator notice of any changes to this address by writing to [email protected] setting out the updated details and to regularly check the Player's email account for emails from the Operator.
14.1 If any part of these Terms and Conditions will be deemed unlawful, void or for any reason unenforceable, then that provision will be deemed to be severable from these Terms and Conditions and will not affect the validity and enforceability of any of the remaining provisions of these Terms and Conditions.
14.2 The time stamp on all records either stored in or written to the Operator's transactional database including but not limited to bets (whether accepted or declined), announcements, messages and reports shall be recorded as Greenwich Mean Time (GMT) plus 0 hours.
14.3 No waiver by the Operator of any of these Terms and Conditions will be construed as a waiver of any preceding or succeeding breach of any of these Terms and Conditions.
14.4 Unless otherwise expressly stated, nothing in these Terms and Conditions will create or confer any rights or any other benefits in favour of any person other than the Player and the Operator.
14.5 Nothing in these Terms and Conditions will be construed as creating any agency, partnership or any other form of joint enterprise between the Player and the Operator.
14.6 Clause 13 (Indemnity) will continue in force after and despite expiry or termination (for whatever reason).
14.7 The Player agrees to be bound by and adhere to the Gaming Rules in their participation in the Service. The Operator also reserves the right to modify the Gaming Rules, including table limits and game features.
14.8 The Operator may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Service.
14.9 These Terms and Conditions, as published in English from time to time, govern this contract. Translations into other languages are made as a service and are made in good faith. In the event of ambiguity between the English version and a translation, the English version prevails over any translation.
14.10 These Terms and Conditions contain the entire agreement between the Player and the Operator relating to the Service. The Player confirms that, in agreeing to accept these Terms and Conditions, the Player has not relied on any representation save insofar as the same has expressly been made a representation in these Terms and Conditions. The Player agrees that the Player will have no remedy in respect of any misrepresentation which has not become a term of these Terms and Conditions save that the Player's agreement will not apply in respect of any fraudulent or negligent misrepresentation whether or not such term has become a term of these Terms and Conditions.
14.11 Players are recommended to retain a copy of Transaction records and Merchant policies and rules.
15 CANCELATION POLICY

15.2 If you played your funds, you cannot cancel any transaction.
15.3 You will have to undergo normal verification procedures and then cashout normally.
